Houston Davis Walthall, II, age 40, of Evington, will be spending 13 years in prison after he pleaded guilty July 16 to two felony counts of distributing heroin in Amherst County. He was found guilty during a hearing in Amherst Court by Circuit Court Judge Michael Garrett who sentenced him to 40 years, but suspended all but 12 years thanks to a plea agreement.
His three-year sentence on one drug charge and a seven-year sentence on the other were the mandatory minimums.
A confidential informant bought drugs from Walthall in April and June of 2018, with both of the buys taking place in a busy Madison Heights shopping area.
Walthall had been convicted in Campbell Circuit Court in April 2017 on four counts of distributing a Schedule I drug. He received jail time in that case.
As a part of the plea agreement he made, Waltham has 27 years of suspended prison time and was ordered to pay $570 in restitution to the Amherst County Sheriff's Office. Also included are 20 years of good behavior at his release which includes two years on supervised probation and drug screening.
